I’m concerned that this is a lie by omission by Toobin. In the case of the right to bear arms case vs. Washington D.C., Roberts sided with the individual. In the cases of individuals vs. Seattle and Louisville public schools, Roberts sided with the individual, arguing the public schools were wrong.
The author seems to be omitting these cases to strengthen the argument…unless the biggest Second Amendment case in years isn’t “a major case”.Report
