    While Iowa is heartland geographically it is a lot different culturally than say a Kansas, Oklahoma, or Nebraska. Iowa (like Illinois and Wisconsin, Minnesota) has a stronger history of progressive (sometimes populist) politics. So this doesn’t really surprise me all that much.Report

    It looks like heightened scrutiny is being applied – the opinion cites Footnote Four in perhaps the only way that libertarians can possibly approve with respect to the protection of discrete and insular minorities.Report

    Mark, if one of the commenters at Volokh is correct, unanimous decisions in Iowa are typical. I’m about halfway through the opinion.Report
