Wednesday Writs Pie Edition

Em Carpenter

Em was one of those argumentative children who was sarcastically encouraged to become a lawyer, so she did. She is a proud life-long West Virginian, and, paradoxically, a liberal. In addition to writing about society, politics and culture, she enjoys cooking, podcasts, reading, and pretending to be a runner. She will correct your grammar. You can find her on Twitter.

Like any true reactionary, Trump wants to bring back firing squads and the electric chair to federal executions and do everything else to knee cap Biden. Though I learned this week that Biden is against the death penalty: https://twitter.com/markmobility/status/1331577585541767169?s=20Report

The reactionary methods of state execution are generally more humane the lethal injection even though they look more gruesome. This is because they tend to be faster at kiling people. The thing is that Americans and many Europeans still wanted the death penality, the campaign to get rid of it in Europe was very top bottom rather than bottom up, but really grew uncomfortable with the optics of it after World War II for good reason. So we invented all these allegedly humane execution methods that are really inhumane but look a lot cleaner than the traditional methods.

We shouldn’t have a death penalty though. State murder is wrong even under the color of law for real monster.Report

Biden’s been the median Democratic Senator for pretty much his whole career. While I’ve never given much thought to Biden’s opinion on the issue, if I had I would have assumed that he opposed the death penalty.

This attempt by the far left to portray him as basically a Republican, or even a centrist, is without basis in reality. He’s only a centrist on a political spectrum consisting solely of Democrats.Report

I know that small-o orthodox Christians consider Biden a godless atheist because he’s pro-choice, but by being against the death penalty, Biden, a practicing Catholic, is actually following the recent Catholic teaching on that matter.

Following Amy Barret’s famous legal article or Catholic judges and cooperation with sin, (https://ir.stthomas.edu/cgi/viewcontent.cgi?article=1113&context=ustlj) I would argue that, as head of the executive branch with direct authority over federal executions, Biden has a more direct responsibility with respect to the death penalty than he might have with respect to abortionsReport

  3. L1 has echoes in a famous case from colonial days. William Penn’s father had two sisters who were well-known as bakers. Good bakers but poor businesswomen, as it turned out; their shop in London failed, and they emigrated to Philadelphia to live with their nephew and start over.

Impressed by the availability of fresh fruit in the New World, they concentrated on fruit-based desserts. In particular, they developed a new recipe for cherry pie, which they sold well below cost in order to help jump-start their business. The other local bakers brought suit for this unfair trade practice, in what became known as the Case of the Pie Rates of Penn’s Aunts.Report

L8: At least this shows taking COVID-19 seriously. Most people are doing moral suasion. PA realizes that a certain amount of coercion and forced virtue might be necessary here even if the efforts are predictably failing.Report

L5 – Dave Chapelle recently announced a similar thing; Netflix was airing his back catalog from his Comedy Central days, but Chapelle wasn’t seeing any money from it. Legally, Netflix seems to be in the right, as they seemed to have paid Comedy Central a ‘fair’ price and the dispute is actually between Chapelle and Comedy Central. But Netflix pulled the episodes anyway, because they have a bigger current deal directly with Chapelle and want to stay in his good graces.Report
