  2. It is hard to imagine much more that Trump would do if he were actively working for the Chinese or Russians. I don’t believe he is (he’s just an elderly idiot) but it remains a daunting mental exercise.Report

        1. I believe that you can have standing recognized on the basis of imminent harm. Though even then, I do supposed that it might take more than a day or two to get things going.Report

          1. I wonder if the market is pricing in the probability of a suit like this eventually succeeding (and Trump actually following the order). Well, I guess the assumption is that it is — likely not a high probability and some damage would already be done regardless.Report

Given that the “Major Questions Doctrine” was made up horse hooey to keep Biden (and Obama retroactively) from being successful, I would doubt such things would do much good, much less be allowed by the Courts. A other to remedy this exists but House Speaker Johnson cares. It to take up his powers and use them.Report

      1. Some version of the Major Questions Doctrine is obviously correct. Congress can’t just delegate unlimited lawmaking power to the executive branch. There has to be some limit. But it’s not really feasible for Congress to specify every detail. The reasonable compromise between these extremes is that Congress can delegate the finer details of implementation of a law to the executive, but that the executive must stay comply with the spirit of the law and not unilaterally decide major questions.Report
