    This is the dumbest possible idea. Why would Garland leave the second best legal job in the country (only to the one he SHOULD have) that offers lifetime tenure and the world’s best retirement plan for a temporary gig in law enforcement.

    Seriously, federal judges get to go on “senior status” (100% pay, still get clerks, and can pick and choose which/how many cases they want). Why would he leave that to be in a position where Trump could fire him at will.Report

        I think it’s more than a bit of a stretch.

        He should have received a vote, as Bork did.

        I tend to think if he had received, he would have been confirmed, but if he hadn’t, well that’s how the cookie would have crumbled.Report

      Well, in theory he could accept the appointment then ask the head of his court for a leave of absence to serve as director of the FBI. Since he is the head of said court he could then approve the request and serve as director of the FBI without leaving any vacancy. The spinning republican heads could also be harnessed for at least a few megawatt hours worth of low CO2 electricity. But I am pretty sure those kind of shenanigans are only permitted on the right.Report
