    An otherwise thoughtful, well written piece marred by misstatement of fact. Sex offenders have the LOWEST recidivism rates. Over 90% of all sex crimes are first timers, friend, family members – someone known to the victim. That’s Grampa entering early stages of Alzheimers or 14 year old curious cousin Timmy(14 year old boys are the fastest growing population on the sex offender registry).

    In my family, my 11 year old niece claimed her 14 year old cousin raped her every day for two weeks – two years ago – during a tantrum when she was not allowed to attend a party.

    How a little girl can be raped multiple times and still be ‘intact’ – and how an utterly terrified 14 year old boy can pass polygraphs saying he didn’t do it are a mystery still unexplored to this day.

    Rape shield laws prohibited the victim’s prior accusations, and her years of sexual abuse therapy from two prior accusations.

    The little girl enjoyed her party because children don’t lie, and the boy is on a sex offender registry the rest of his life.

    Maybe if we execute him he’ll stop passing polygraphs saying he didn’t do it.Report

    I have been advocating false accusers be placed on sex offender registries. Currently, very few are held accountable, and certainly rarely punished. Rape shield laws hide their prior activities. This is not a ‘small’ crime they have committed – it is as bad if not worse than the crime they are lying about. Men have spent decades in prison on the word of a false accuser.

    The public needs to know who does this, and how often it is done.Report

With this 18 year old kidnapping that was just solved the registry really helped there and can only imagine what some of these politicains will dream up next to stop it from happening againReport

    I think some folks here might change their tune about how harmless true child molesters are if their child was molested. Funny thing, in jail even other criminals treat molesters like the scum they are. Sorry Bob, now that the S.Ct. has gone soft and won’t let states execute rapists, we won’t be able to get the molesters.

    As for registration it is a creature of our federal system with each state being allowed to decide how it wants to approach the issue. That is until the fed gov gets involved and once again sticks its nose in state affairs.Report

      I don’t think anyone here is singing any tunes about the safety of molesters, but as much as we may hate them we have to understand that once we ask government to protect us by taking away fundamental Constitutional rights from those we fear/hate, it sets precedence to take similar rights from others.
      Our protection as citizens from ex post facto laws, and bills of attainder has been sorely challenged now that we’ve OK’ed taking that right from Chester & Co.Report

    I was molested as a child, and my ‘tune’ has not changed — I abhor the idea of an innocent person being convicted of a crime they did not commit.

    As the laws stand now, anyone accused of child molestation is pretty much fast tracked into a conviction.

    If you can argue with that last statement, speak now or forever hold your peace.

    How can anyone even THINK of execution with the sorry state our justice system is now in.

    How can anyone even THINK a child will be better off having caused another person’s death?

    More and more in this country it seems the things we claim to abhor about ‘evil empires’ are the very things we later embrace — Nazi Germany has been our favorite punching bag for over 60 years now — yet we are now doing EXACTLY the evil things they did, #1 on the list is public registries!

    We have replaced the Soviet Union as the highest population of incarcerated men.

    Even though castration didn’t work for the Nazis, we are now in the business of doing that, and other things that didn’t work.

      So when you’ve got an issue where this guy did this thing with this other person… well, what can you do? You can kill the guy (Bob’s answer). You can imprison the guy. You can put the guy’s name on a list.

      The other option, more or less, seems to be “nothing”.

      I took an oath to defend the Constitution of the United States, and I intend to do just that.

      Juveniles are NOT allowed jury trials in many states. If you have evidence that contradicts that, please present it. I already know you don’t – so please refrain from making further false statements.

      The United States now has FOR PROFIT prison systems. Accusing other countries of ‘lying’ and secretly having more prisoners requires more than just your word – since so far your word is 100% incorrect. Present the truth, or keep your false opinions to yourself.

      If you want to live in a country that has no due process rights, or no longer recognizes the Constitution, then I suggest YOU leave. I’m staying here and defending the principles this country was founded on – the very thing that made this a great country.

      Public registries started with Nazi Germany, and it was the Good Germans that hid their head in the sand and let it happen.

      In Germany they first came for the Communists,

      The United States does have one of the highest if not the highest incarceration rates per population ratio in the world. And what makes this even worse is the fact that the prison system is so over populated that the system can not handle the people that are locked up. That is clear by the recent Federal court orders to Florida and California to dramatically reduce their prison population. Not to mention numerous World wide Human Rights organizations have condemned the U.S. for the human right violations that are occurring here. And we are supposed to be the world leader in human rights issues. What do you think is happening here with all these sex offender laws and restriction being put on a group of society that has been singled out JUST LIKE THE NAZI’S DID TO THE JEWS….THIS IS HOW IT STARTED THERE.           My son has endured this situation for over 10 years now, with no ending in sight. With the implementation of the Adam Walsh Act the situation only promises to become far worse. This recession is horrible for our country and has negatively impacted my family as much as anyone’s…but it has kept this particular nightmare law at bay through lack of funding, and for that I am…grateful…

          However bad this has been for him, my son has not resorted to self pity, self destructive behaviors, or drugs. He is not bitter, does not hate women and has forgiven his accuser. For that I consider it as happy an ending as I can hope for.

          I wish there was more I could do to fight this injustice – not just for my son, but for every innocent person being raped and molested by a justice system run amok. I try to maintain what precious privacy my son has left, but speaking out about this attracts stalkers and certain ‘advocates’ who have viciously gone after others who speak up.

          I appreciate your kind words and support. Speaking the truth and defending the innocent can’t be wrong. Surely God is on our side in this.

      Scott – In my very first post I specifically mentioned my son was 14 years old. That makes him a juvenile – and as an ‘attorney’ you should have known juveniles do not have the right to a jury trial in many states.

      Apparently you are not a criminal attorney.

      The fact that the US has the highest prison population on earth is not being ‘bandied’ about – it is a fact verified by credible sources.

      We aren’t ‘ashamed’ or secretive about our shameful burgeoning prison population – why would other countries be?

      Until a few years ago, we were the only industrialized nation to still EXECUTE juveniles and mentally handicapped.

      We have children as young as 10 years old pictured on public sex offender registries – male or female.

      Here is an excerpt from a random attorney’s web site about child abuse accusations – there are dozens and dozens that state EXACTLY the same information.

      The Elimination of Constitutional Rights

      Prosecutors and the child saving industry have convinced the legislature that merely creating hysteria is not enough to insure conviction for those accused. In addition, rights originally created in our constitution to protect the criminal defendants must be eliminated.
      The Rules to Have Changed to Secure Convictions

      All across our nation, state legislatures have supported child advocacy special interest groups. The following illustrates how constitutional rights have been taken away in child sexual assault trials:
      No Right to Confront Your Accuser:

      Criminal law codes have been rewritten to where in many cases, the child accuser does not have to appear in court and face the accused. Instead, the state can offer the child’s testimony through a video tape made by agents of the prosecution.
      “Hearsay Evidence”:

      Hearsay is defined as “a statement, other than one made by the declarant while testifying at the trial or hearing, offered in evidence to prove the truth of the matter asserted.” (Tex. Rules. Evid. 803 (2)). In Layman’s terms, “Hearsay” evidence is when a witness testifies about something they do not personally know, but were told by someone else. Hearsay is considered unreliable and is normally inadmissible as evidence against an accused. In child abuse cases however, hearsay evidence is admitted as evidence of guilt. A so called “outcry” witness can testify as to what a child supposedly said to them regarding the alleged abuse.
      “Syndrome Evidence” Is Admissible Against the Accused:

      In most states, the prosecution can have an expert witness testify that the child is suffering from “Child Sexual Abuse Accommodation Syndrome”(CSAAS). This psychological “mumble jumble” is an unscientific theory of supposed traits of abused children. The psychologist who came up with this syndrome many years ago has since indicated that this theory is not reliable evidence in a court of law. Prosecutors do not care! This junk science makes its appearance in courtrooms across the country daily.
      With Syndrome Evidence, the State Replaces Its Lack of Real Proof with Speculation.

      CSAAS theorizes that because an alleged victim is supposedly demonstrating certain behavioral patterns that he/she must have actually been abused. Unfortunately, a big problem with this and other syndromes is that the character traits offered to show abuse are also common for non-abused children. If the child has been crying, he/she must have been abused. If the child has nightmares, he/she must have been abused. If the child is withdrawn, he/she must have been abused. If the child is outgoing, he/she must have been abused. If the child is happy around the accused, its because the child enjoyed the abuse. The list of factors goes on forever. But to a jury, when an expert witness is connecting typical childhood behavior with indicators of abuse, the testimony is extremely damaging to the falsely accused.
      Convictions Without Physical Evidence:

      Our prisons are full of persons who have been convicted of child molestation without any physical evidence ever introduced against them at trial. In other words, the typical evidence in which the state offers to convict a defendant, such as body fluids, blood, semen, hair, DNA, are not introduced at trial to link the accused to a crime.

      Medical nurses and employees whose livelihoods depend upon their contracts with child advocacy centers will give opinions that a child was abused. Failure to give the right opinion will mean the contract is not renewed. These opinions from medical “experts” will say the findings are “consistent with” sexual abuse. Of course, “consistent with” is not a true medical diagnosis. This testimony, as demonstrated by a competent defense attorney will reveal the findings given as “consistent with abuse” are just as “inconsistent with abuse”.

      Prosecutors Secure Convictions by Manipulating the Juries’ Fear of

      Releasing a Child Molester Back Into the Community.

      Instead of physical and medical evidence, the falsely accused are convicted upon theories, inferences, and speculation. Prosecutors secure convictions by manipulating the juries fear of releasing a child molester back into the community. This fear will be combined with hearsay, expert witness “syndrome evidence”, misleading medical testimony, and the biased opinions of child advocacy investigators.

      To support this speculation, a biased child protective services caseworker will produce a video taped interview of the child. This biased interviewer will use leading, suggestive, and coached questions to easily obtain an “admission” from a child. Many times the child does not make a statement that abuse occurred, but merely agrees with the adult authority figure who informs the child of the abuse.

      After an outcry, it is easy to find witnesses who can place the accused in circumstances in which he was alone with the alleged victim.

Yes, any lawyer, even a litigator like myself, can tell you that juveniles don’t get all of the same con law protections that adults do, that was Con Law 1. However , states are free to give juveniles jury trials if they want to. Last time I checked though, the focus of this discussion was adults not juveniles. Clearly you are bitter and have an axe to grind and that is fine.

    Second, are there are any credible sources for how many prisoners the Chinese have in their jails? I think not, but when you find one then you can tell me all about how the US is the worst. Your argument about the US prison population is analogous to arguing that Florida has the most orange trees in the US when you have no clue how many orange tress are in California. As for executing juveniles and the retarded, who cares as long as they get all the due process guaranteed by law. When the constitution was written it was considered to be legal and I fail to see how that has changed. Heck, you used to be able to execute rapists until the activist judges stared thinking that “evolving standards of decency” was a legal term or had some place in jurisprudence. You really should go to law school, you might learn something.Report

Children as young as 10 are listed on sex offender registries, and there is certainly no reason to exclude them from this conversation. They suffer the same stigma and restrictions as any adult on the registry, without benefit of full Constitional laws.

        I just had a repressed memory of Scott molesting me, too.

        Two of us now remember Scott molesting us. Remember, only guilty people say they didn’t do it. Innocent people don’t get accused.

        I’m sure when word gets out, or we start sending out letters to the public to see who else remembers Scott molested them, SOMEone else will remember as well.

    Getting to maters that mater is something we seem to be able to get down to humbly; I would like to share this with you. This from my life experience is a true connection to the ties of races through our own sex laws which have been built on misconceptions and myth.

    The Supreme Court just ruled on sex offender laws where some factions of our government think by some inert reasoning that sex offender should be quarantined like some virus steaming from draconian/Islamic law sex offenders should be executed. I have seen for myself, video taken in another country where a sex offender is placed on a pole much like the Catholics use to use a pyramid shaped object and have them sit on it and spin, the pole travels through the body looking for the throat but if not found its ok cause the sharpened end of the pole will come out somewhere. The heritage of the act is in its self a throwback to troglodyte’s who are so obsessed with sex they can find that the way to deal with the issue is as revolutionary, as war, and two wrongs don’t make a right but has in fact called up deep rooted issues of people who have had to put up with this kind of “hierarchy” of historic hysteria far to long. A word taken from hysterectomy, hysteria is tied to castration used to make animals less threatening right? Good old Monty Hall. Well no wonder it’s wrong, right?

    Anyway we are supposed to be the most advanced nation and we still have a death penalty when the rest of the world except for nations we are still warring with, {think!} While other nations went home our weapons dealers and torture lovers delighting in support for the death of people they don’t know or want to simply because they don’t know how to get money with out taking it from someone by force, is that supposed to includes mutilations? In my humble opinion that alone are terrorist activities as much as severed hands, ears, heads, or making a case with nothing more than an obsession justified by lies.

    The truth about the sex offender registry will come out soon enough. When it does, People will see how the use of the registry was created, and by exactly who and why and the devastation it has created and the worthlessness of the use of it. It’s origin in the Crow laws that brought disgrace to our nation allowing thieves and murderous societal bigots who have trashed any shot at making good of a program in its design to make money destroying our nation and its people. We can not play god and we can not survive using this behavior model because you are compounding the problem.

    It’s a ruse designed by people who are getting rich off the castration/hysterectomy/health care/physic care of people thrusex laws that have gone bonkers. What about the people who are being used by the Medicare programs that requires these mutilations for both men and woman after they take their means of support? Can’t you see? You have created the model and it is worthless! Why don’t you just indiscriminately kill people you don’t know that’s statically the next sex offender because over 90% of all new offences are people not on the sex offender registry and the numbers are increasing not decreasing so as a behavior model the chumps put together is really screwed up and they were told before they tried it. So what is the use of such laws as the sex offender registry other than to terrorize people? With the murder of so many sex offenders and the continued disregard for life by the use of the registry it’s just a mater of time before the federal government will be held liable for the deaths through federal court.

    In a nation where a statement may have a double or triple meaning and our entire linage can be traced through mud, guts, and beer it’s nice once in a while to get the picture of what is meant instead of what some thinks someone may have implied. So it is from the trenches to the hill. Remember the game where someone says something in someone’s ear then passes it the same way to the next; I stopped dancing before I started this hitch.     Photographs of brave firemen rescuing people from burning buildings dominated the news. DV shelters emptied – for a brief shining moment the realization that Big Daddy Government was not there to protect us chilled the anti-male sentiment that dominates our daily American lives.

    It didn’t last, however.

    ‘Advocates’ may not be capable of saving us from burning buildings, but they can still be IMPODTANT heroes anyway. Create a problem. A HUGE problem. Assure the victims of this problem they are forever helplessly damaged and in need of ‘saving’. False accusations are strongly encouraged, and never punishable to fill in the gaps. Incarcerate, vilify, register every living male capable of contributing to this society so when they DO save children from burning buildings, they are still the bad guy.Report

    Sad to say, but most people would qualify for the Registered Sex offenders list! Ever piss out side? If a kid had turned a corner and saw it…slam! Ever had a one night stand after a woman had a few drinks? Dude, you just took advantage of a woman under the influence of alcohol! These are only a couple of our crazy laws. It is if nothing else a deterent for those currently on it to keep there noses clean and for others to possibly think a little harder before acting in the heat of the moment with someone who is underage. I know 16 or 17 seems old enouph to make adult decisions but we have to draw the line somewhere. The law says 18 is an adult, we don’t bend the rules on joining the military or buying ciggarettes and we shouldn’t bend it here. The fact remains that those with sexualy deviant tendancies very rarely can control or change those urges, however harmless it may seem. Sexual offences often are violent and I believe we have come a long way to put these important laws in affect and SHOULD NOT back track now. So sorry you made a bad decision, I guess someone should have taught you about the law and about consequences. Cry me a River!!!Report

But when you post your opion and it’s far from what the real truth is, it only adds to the confusing mess we now have with the issue of sex offenders.

Family and freinds are a very important part of these offenders support network….a suport network that helps to keep the offenders living a productive life.
      You mention 16, 17 and 18 year olds having sex and becoming sex offenders and you are ok with that….think back to school, be honest with yourself about what you did or allowed to happen to you sexual when you were in high school. Face it sex has been and always will be a right of passage so to speak that takes place in a persons teenage years…Think back about grandma and grandpa or the great grandparents getting marries at 14 or 16 years old….well so far everything i have stated lables them all sex offenders…you state you cant join the military or buy smoking material unless 18….thats true then with that in mind why does the government charge and convict kids as young as 12 years of age as sex offenders….why do they wave children 12 into adult court for other crimes…..they cant have it both ways….there to young and foolish to be able to wisily chose to have sex, to young to chose to smoke but yet they are wise enough to no better and be waved in to adult court for crimes
      You state “The fact remains that those with sexualy deviant tendancies very rarely can control or change those urges, however harmless ” you are falling into the myth that sex offenders are always sex offenders and that they will offend again…..John Walsh the guy from Americas most wanted addmitted he was a sex assict…but he is curd….but yet he says no sex offender is ever curd…and he pushes this law threw congress with his million because he believed a sex offender killed his kid and turns out it wasn’t a sex offender…..a recidism rate that has been publish to congress at least 4 times put the rate of re-offending at 5 to 6 percent pretty low by any ones standards. So they can and do controll those tendencies or the rate would be well above those figures….then you go on “Sexual offences often are violent ……another myth….sure they are classified violent because some senator wrote a law that says if you are convicted of this this or that it’s a violent crime…you readize veiwing child pron or breast feeding one of your children in public is by statue violent…wheres the violence
      I am sorry I just can’t except the way you are looking at these issues…these laws do more harm then good, they put your daughters in more danger then they do protecting them…these laws are forcing offenders to run , to hide, assume different idenities so they can find work, find a place to live all in a attempt to stay out of trouble and support there familys…heck they guy down the block from you that just moved in could be just one of those offenders forced to hide to support his family…why? Because of these do nothing feel good laws that say he cant live here or there cant work at this or that…cant live near a park ….you just can’t see what these laws are doing….then you look at how they are destroying our constitution and it’s only a short while and the government will expand on these laws to include a lot more… till they take your next childs dna at birth and add it to a data baseReport
